Ziel dieser politologischen Fallstudie ist die Bewertung der Umsetzung der
Wasserrahmerichtlinie (WRRL) in Polen unter besonderer Berücksichtigung der
Partizipation. Das zugrundeliegende empirische Beispiel ist die
Odermündungsregion (OR), eine gewässerreiche Küstenregion in Polen, die ca. 10
km von der Ostsee entfernt ist. Als Grundlage der Bewertung werden zunächst
die relevanten EU-Maßstäbe aus den einschlägigen EU-Dokumenten
herausgearbeitet: Diese Maßstäbe werden anschließend sowohl in ihrer Rezeption
durch die dem Fallbeispiel zugeordneten Stakeholder betrachtet, wie hin-
sichtlich der Wirkung dieser Rezeption auf die Zielsetzungen der WRRL; ebenso
werden die Maßstäbe herangezogen, um die materiellen Ergebnisse der Anwendung
der WRRL im Untersuchungsgebiet zu beurteilen. Bei dieser Beurteilung steht im
Vordergrund, welche Effekti-vitäts- und Legitimitätsziele, materielle Ziele
und Modalitäten sich durch ‚gute Partizipation‘ in Sinne der WRRL erreichen
lassen und welche Umstände dabei wirksam sind. Das Politikinstrument der EU –
die Partizipation – ist ein wichtiger Bestandteil der Umsetzung der WRRL. Es
stellt neben den materiellen Zielsetzungen der EU-Politikbereiche eine
zusätzliche Herausforderung für das EU-Mitgliedsland Polen dar; denn die
Gestaltung entsprechender Prozesse setzt weitere Reformen voraus und werden
zusätzliche Ressourcen benötigt. Zur Bearbeitung des Themas werden die
folgenden Teilfragen gestellt: • Welche Bedeutung hat die Partizipation
generell bei der Umsetzung von Politiken im Bezug auf Effektivität und
Legitimität? • Was zeichnet - im Sinne der Europäischen Union (EU) - den
Maßstab und die materiellen Ziele bzw. Modalitäten der ´guten Partizipation´
als Teil von Good Governance aus? Welche Auswirkungen hat das subjektive
Partizipationsverständnis der polnischen Wasserwirtschaftsverwaltung auf die
Umsetzung der ´guten Partizipation´ der WRRL und des Leitfadens zur
Beteiligung der Öffentlichkeit hinsichtlich Programmatik und Praxis? Warum
wendet die Wasserwirtschaftsbehörde die EU-Maßstäbe guter Partizipation an
bzw. warum nicht? • Welche Ziele und Modalitäten der ´guten Partizipation´
wurden in der OR gemessen an der Umsetzung der Vorgaben der EU, erreicht? Zu
der empirischen Grundlage der Methode zählen eigene Interviews mit den
Vertretern der Wasserbehörden in Polen sowie Dokumentenanalyse der polnischen
und europäischen Behörden aus den Jahren 2000-2015. Der bereits durch Jens
Newig festgestellte empirische Befund, dass die europäische Politik nach mehr
Effektivität als Legitimität strebt, wird auch in dieser Arbeit bestätigt.
Allerdings empfiehlt die Autorin, dass das Verständnis der Partizipation als
ein offener Prozess verstanden werden sollte, der immer auch an die lokalen
Gegebenheiten angepasst werden muss. Dieses Verständnis sollte
differenziertere Kriterien für die Bewertung der Effektivität der Umsetzung
der WRRL und für die Akzeptanz durch die Öffentlichkeit entwickeln. Darüber
hinaus sollte den Legitimitätszielen in den europäischen Regelungen größere
Bedeutung beigemessen werden. Die europäische Politik kann nur dann Erfolge
haben, wenn Effektivität UND Legitimität gleichermaßen angestrebt werden.

This case study from the political sciences aims to evaluate the
implementation of the Water Framework Directive (WFD) in Poland under special
consideration of participation. The empirical example is the Odra estuary
region (OR), a coastal region rich in waters located about 10 km from the
Baltic Sea. The evaluation carried out in this case study is based on EU
standards for implementing the WFD which are distilled from relevant EU
documents. These standards are then considered in terms of their reception by
the stakeholders in the case study area, as well as the effects this reception
has on achieving the objectives of the WFD. The same standards are also used
to evaluate the material results of implementing the WFD in the case study
area. This primarily focuses on objectives of effectiveness and legitimacy, as
well as the material objectives and modalities that can be achieved through
‘good participation’ in sensu WFD. Here the study also asks what circumstances
may have an impact on this. Employed as a political instrument by the EU,
participation is an important element in implementing the WFD. At the same
time, it represents an additional challenge for Poland as it comes on top of
material objectives pursued by EU policy areas. The introduction of
appropriate processes to facilitate participation requires further reforms and
additional resources. The study raises the following subordinate questions to
illuminate the topic: • What is the significance of participation generally in
policy implementation with respect to effectiveness and legitimacy? • In the
sense of the EU, what characterises the standards, material objectives and
modalities of ‘good participation’ as an element of good governance? • How
does the Polish Water Administration’s subjective understanding of
participation affect the implementation of ‘good participation’ of the WFD and
the guideline on public participation with respect to general political
objectives and practice? Why does the Water Authority make use of the EU
criteria for ‘good participation’, or why does it not? • Which objectives and
modalities of ‘good participation’ have been achieved in the OR as judged by
the implementation of the EU’s requirements? Interviews with representatives
of the water authorities in Poland, and an analysis of documents published by
Polish and European authorities in the period 2000-2015, serve as an empirical
base. The results of this case study confirm empirical evidence first provided
by Jens Newig, namely that European policy is striving for greater
effectiveness rather than legitimacy. A recommendation is that participation
should be understood as an open process which always needs to be adapted to
the local context. This understanding of participation should develop more
differentiated criteria for evaluating the effectiveness of implementing the
WFD and its public acceptance. Objectives of legitimacy should be given
greater emphasis in European regulations. European policy can only be
successful if effectiveness AND legitimacy are pursued as equal goals.
